Welcome to Carousel Candies (the “Site”). These Terms & Conditions (“Terms”) govern your access to and use of www.carousel-candies.com and any related services, features, content, or applications (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms (collectively, the “Agreement”). If you do not agree, please do not use the Services.

1) Who We Are

The Services are provided by Silvestri Sweets, Inc. dba Carousel Candies, located at 2248 Gary Lane, Geneva, IL 60134, USA (“Carousel Candies,” “we,” “us,” or “our”).

2) Eligibility & Your Account

• You are responsible for maintaining the confidentiality of your account      credentials and for all activities under your account.
• We may refuse, suspend, or terminate accounts at our discretion, including for policy or legal reasons.

3) Product Information, Allergens & Food Safety

• Ingredients & allergens. Our confectionery may contain or come into contact with milk, soy, peanuts, tree nuts, wheat, and other allergens.      Cross-contact can occur despite best practices. Always check labels and      product pages before purchase. If you have severe allergies, please      contact us before ordering.
• Handmade variation. Colors, sizes, shapes, and weights may vary between batches due to handcrafted processes. Product photos are illustrative only.
• Shelf life & storage. To preserve quality, store candy in a cool, dry      place away from heat and sunlight. Follow “Best By” or “Use By” guidance on packaging where applicable.
• Temperature sensitivity. Many products can melt in warm weather. See Section 6 (Shipping) for warm-weather handling.
• Nutrition & labeling. We strive to provide accurate labels and nutrition      info, but minor variations can occur. Always rely on the actual packaging      upon receipt.

4) Orders & Payment

• Offer & acceptance. By placing an order, you make an offer to purchase;      we accept when we confirm the order or ship the product. We may cancel or refuse any order (e.g., suspected fraud, inventory limits,      pricing/description errors).
• Pricing & taxes. Prices are shown in USD, exclusive of applicable sales      tax, shipping, and handling. Taxes and shipping rates are calculated      at checkout.
• Payments. We accept [Visa, MasterCard, AmEx, Discover, PayPal, etc.] via our payment processor. You authorize us and our processor to charge your selected payment method.
• Promotions & codes. Promo codes are single-use, non-transferable, and may not be combined unless explicitly stated. We may modify or cancel promotions at any time.

6) Shipping, Delivery & Risk of Loss

• Shipping regions. We currently ship to United States only. We do not ship to P.O. boxes where carrier restrictions apply.
• Fulfillment times. Typical processing time is 5 to 10 business days. Processing times may extend during holidays or high-volume periods.
• Warm-weather shipping. To reduce melt risk, we may use insulation and/or ice packs and may limit shipments to faster methods during warm months. Additional fees may apply. We cannot guarantee products will not melt in transit, and we are not responsible for melting after delivery.
• Delivery confirmation. Risk of loss passes to you upon carrier delivery      confirmation to the address you provided. Please ensure someone can      receive the package, especially in warm weather.
• Shipping errors. Ensure your shipping address is accurate. We are not      responsible for delays, loss, or additional costs due to incorrect or      incomplete addresses.
• Title. Title to products passes upon shipment.

7) Returns, Refunds & Replacements

Because we sell perishable items:

• All sales are generally final. For food safety, we typically do not accept returns.
• If your order arrives damaged, incorrect, or missing items, contact us      within 3–5 business days of delivery with your order number and photos. We may offer a replacement, credit, or refund at our discretion.
• Melted items are generally not eligible for refund; see warm-weather      policy above.
• Gift cards and promotional items are non-refundable.

8) Gift Cards & Store Credit

• Gift cards are non-refundable, not reloadable, and not redeemable for cash except where required by law. Lost or stolen cards will not be replaced.
• Store credits expire in accordance with applicable law or as stated at issuance.

9) No Resale & Wholesale Policy

Purchases are for personal use or gifting only and not for resale without our written authorization. For bulk or corporate orders, please contact customerservice@carousel-candies.com.

10) User Content (Reviews, Photos, Feedback)

If you submit reviews, photos, or feedback (“User Content”):

• You grant us a non-exclusive, royalty-free, worldwide, perpetual,      irrevocable, sublicensable license to use, reproduce, modify, publish,      and display your User Content in any media for marketing, operations, and      improvement of the Services.
• You represent that you own or have rights to the User Content and that it does not infringe third-party rights or violate law.
• We may remove or refuse User Content at our discretion.

11) Acceptable Use

You agree not to:

• Use the Services for unlawful, deceptive, harmful, infringing, or harassing purposes;
• Interfere with security or integrity (e.g., hacking, scraping beyond robots.txt, reverse engineering);
• Submit false orders, fraudulent claims, or misleading information;
• Upload malware or engage in activities that degrade Service performance.

12) Intellectual Property

All content on the Services—including text, designs, logos, graphics, photos, product names, and code—is owned by or licensed to Silvestri Sweets Inc., dba Carousel Candies and protected by intellectual property laws. You may not copy, distribute, modify, create derivative works, or exploit the content without our prior written consent. All trademarks are the property of their respective owners.

13) Third-Party Services & Links

The Services may contain links to third-party sites or use third-party tools (e.g., payment processors, shipping carriers). We are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms and privacy policies.

14) Privacy & Cookies

Your use of the Services is subject to our cookies policy on the website www.carousel-candies.com, which explains how we collect, use, and share your information, and our cookie practices. By using the Services, you consent to those practices.

15) Accessibility

We strive to make our Site accessible to all users. If you encounter accessibility barriers, please contact customerservice@carousel-candies.com. We will work to provide the information or transaction you seek through an accessible communication method.

16) Disclaimer of Warranties

To the maximum extent permitted by law, the Services and all products are provided “AS IS” and “AS AVAILABLE.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that product descriptions or content are accurate, complete, or current.

17) Limitation of Liability

To the maximum extent permitted by law, Silvestri Sweets Inc., dba Carousel Candies and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or other intangible losses, arising from or related to your use of the Services or products, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid for the product(s) at issue in the 30 days preceding the claim.

Some jurisdictions do not allow certain limitations; in such cases, the limitations shall apply to the fullest extent permitted by law.

18) Indemnification

You agree to indemnify, defend, and hold harmless Silvestri Sweets Inc., dba Carousel Candies and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your violation of these Terms, or your infringement of any rights of a third party.

19) Governing Law; Dispute Resolution

• Governing law. These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules.
• Venue. You agree that the state and federal courts located in Kane County, Illinois shall have exclusive jurisdiction over any dispute not      subject to arbitration (if arbitration is not used).

20) Export & International Use

You may not use or export the Services or products in violation of U.S. export laws and regulations. Users accessing the Services from outside the U.S. are responsible for compliance with local laws.

22) Changes to the Services or Terms

We may update the Services and these Terms from time to time. Changes take effect upon posting with the “Last updated” date above. Your continued use after changes constitutes acceptance. If changes are material, we will provide reasonable notice (e.g., banner or email, where available).

23) Severability; Waiver; Assignment

If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect. Our failure to enforce a right or provision is not a waiver. You may not assign or transfer your rights or obligations without our consent; we may assign these Terms as part of a merger, acquisition, or asset sale.

24) Entire Agreement; Survival

These Terms and the Privacy Policy constitute the entire agreement between you and Carousel Candies and supersede all prior agreements regarding the Services. Provisions that by their nature should survive (including IP, disclaimers, limitations of liability, indemnification, and governing law) shall survive termination.
